Export Compliance and Trade Terms Policy

This Export Compliance and Trade Terms Policy (“Policy”) sets forth the international trade practices of Upsense Exports (“we”, “us”, or “our”). As an export-oriented firm, we are committed to conducting our business in compliance with applicable laws, regulations, and internationally recognized trade standards.

1. Compliance with Export Laws


Upsense Exports complies with all applicable Indian export laws, rules, and regulations, including those governing customs, duties, and licensing. We also comply with international trade restrictions, including sanctions and embargoes imposed by the United Nations, the Government of India, or other applicable authorities.

2. Buyer’s Responsibilities


The buyer is responsible for ensuring that the importation of products into their country complies with local laws, regulations, and restrictions. Buyers must obtain any necessary permits, licenses, or approvals required by their local authorities before goods can be imported.

3. Trade Terms (Incoterms)


All shipments from Upsense Exports are governed by internationally recognized Incoterms® rules. The applicable Incoterm (e.g., FOB, CIF, EXW, DAP) will be specified in the proforma invoice or sales contract. Unless otherwise agreed, the default trade term shall be **FOB (Free on Board) Port of Loading, India**.

4. Restricted and Prohibited Destinations


Upsense Exports does not ship products to countries or regions subject to international trade sanctions or embargoes. Orders found to be in violation of such restrictions will be canceled without liability.

5. Export Documentation


We provide complete export documentation with every shipment, which may include the commercial invoice, packing list, bill of lading/airway bill, certificate of origin, and any other documents required by the buyer or destination country. Any additional certifications or legalizations requested by the buyer may incur extra charges.

6. Force Majeure


Upsense Exports shall not be held liable for delays or non-performance caused by events beyond our control, including natural disasters, strikes, government actions, war, embargoes, or disruptions in international logistics.

7. Dispute Resolution


Any disputes arising under this Policy shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts in Kolkata, India.
